The 2nd Edition of Walmsley on Business Interruption is welcome at a time when the role of business interruption insurance has taken a more prominent place in UK commercial insurance industry discussions. In this substantially revised edition of Walmsley, the author Celso de Azevedo manages to reflect these latest business interruption concerns at the same time as providing a succinct introduction to the principles and practical operation of business interruption insurance common in the UK and abroad.

A core intention of Walmsley – the subtitle being “Law and practice” - is to capture the developments of insurance law and the latest (as at May 2016) English law changes to support commentaries on the various aspects of business interruption examined in the chapters. The author’s extensive practical legal experience as a solicitor specialising in business interruption provides additional weight to this analysis. A remarkable feature of the book is how the essence of relevant case law decisions and statute have been extracted and distilled into easily digestible points. Because the book tackles some key areas, such as the indemnity principle, insurable interest, causation, exclusions and property perils, the value of this commentary extends beyond business interruption matters and would be useful reference for a much wider audience interested in first party insurance.

The book builds from a basic introduction to risk to an in-depth exploration of the meaning of the words used in Gross Profit policies. For source material the author mainly focuses on the Association of British Insurers recommended standard wordings which are reproduced in the Appendices with excerpts examined throughout the chapters to illustrate different subjects. Although commercial market products often vary from these wordings, core expressions remain typical and influential in the UK and indeed broader global insurance markets, which justifies this focus. Explanation on the mechanics of these wordings is enhanced by discussion on recent findings from English and Scottish courts and reflections on the policy wording challenges raised by the freely available joint CII/CILA 2012 publication “Business Interruption Policy Wordings – Challenges Highlighted by Claims Experience” (readers may find additional value in cross referencing topics between the two books). Accordingly, the author deals with a number of pertinent business interruption subjects including wide area damage, effect of the Insurance Act 2015 and underinsurance concerns. Helpfully, the book generally suggests drafting solutions to the issues raised and provides useful notes on how to achieve variations of cover from the Gross Profit form as well as discussing alternative wording approaches.
